Privacy Policy

This Privacy Policy explains how the company behind askedwhy ("askedwhy", "we", "us", or "our") collects, uses, and shares personal information in connection with askedwhy and its websites, applications, and related services (the "Service"). It forms part of, and should be read with, our Terms of Service.

1. Two roles: when we are a controller, and when we are a processor

For information about our account holders and website visitors — the people who sign up for and administer the Service — we act as a data controller and this Policy governs.

For interview content and participant information, we act as a processor on behalf of the customer who created the interview. That customer decides why and how the interview is run and is the controller of the participant's information. If you took part in an interview and want to exercise your rights or ask how your information is used, please contact the organization that invited you; they are responsible for that information, and we handle it only on their instructions.

2. Information we collect

  • Account information — name, email address, organization name, and a hashed password when you create or manage an account.
  • Billing information — plan and transaction details. Payments are handled by our payment processor; we do not store full payment-card numbers.
  • Interview content — audio, transcripts, and responses from interviews, and any name or email a participant provides. We collect this on behalf of, and on the instructions of, the customer running the interview.
  • Usage and device information — IP address, browser and device type, pages viewed, actions taken, and similar log data, and information from cookies and similar technologies.

Participants are told before the microphone opens that they are speaking with an AI, what is recorded, and how to stop. Please do not provide sensitive personal information unless the interview specifically and lawfully asks for it.

3. How we use information

  • to provide, maintain, secure, and support the Service;
  • to transcribe interviews and generate summaries, counts, and other analysis for the customer;
  • to process payments and manage accounts;
  • to detect, prevent, and address fraud, abuse, and security incidents;
  • to improve the Service, including through aggregated or de-identified data that does not identify any individual;
  • to communicate with you about your account and the Service; and
  • to comply with law and enforce our Terms.

4. Legal bases

Where data-protection law such as the GDPR or Canada's PIPEDA applies, we rely on one or more of the following: performance of a contract with you; our legitimate interests in operating and improving the Service; your consent (or, for participant information, the consent obtained by the customer); and compliance with legal obligations. Where we act as a processor, the customer is responsible for establishing a legal basis for the interview.

5. AI and automated processing

We use third-party artificial-intelligence providers to power the live interview and to transcribe and analyze interview content. Content sent to those providers is processed to deliver these features and is subject to the provider's terms and privacy commitments. Automated output may be inaccurate and is described further in our Terms of Service.

6. How we share information

We do not sell personal information. We share it only:

  • with service providers that help us run the Service — for example AI processing, cloud hosting, data storage, email, and payment providers — under contracts that limit their use of the information;
  • with the customer whose interview generated the content, which is the purpose of the Service;
  • when required to comply with law or a valid legal request, or to protect the rights, safety, and property of askedwhy, our users, or the public; and
  • in connection with a merger, acquisition, or sale of assets, subject to this Policy.

7. Storage, security, and international transfers

Information is stored on cloud infrastructure and, where recordings are enabled, in cloud object storage. We use technical and organizational measures such as encryption in transit and at rest and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Information may be processed in Canada, the United States, and other countries whose laws may differ from yours; where required, we use appropriate safeguards for such transfers.

8. Retention

We keep account information for as long as your account is active and as needed to provide the Service, comply with law, resolve disputes, and enforce our agreements. After an account is deleted, we delete or de-identify associated personal information within 30 days, except where we must retain it for legal reasons. For interview content, the customer controls retention; we act on the customer's instructions.

9. Your rights and choices

Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent. Account holders can exercise these rights through account settings or by contacting legal@askedwhy.com. If you are a participant, contact the organization that invited you, which controls your information; we will assist that organization as its processor. We do not sell or "share" personal information as those terms are used under laws such as the CCPA, and we will not discriminate against you for exercising your rights.

10. Cookies

We use cookies and similar technologies that are necessary to sign you in and keep the Service secure, and to understand usage so we can improve it. You can control cookies through your browser settings; disabling some cookies may affect how the Service works.

11. Children

The Service is not directed to children, and we do not knowingly collect personal information from anyone under 18. Customers must not use the Service to interview anyone under 18 without verifiable consent from a parent or guardian. If you believe a child's information has been collected, contact legal@askedwhy.com and we will take appropriate steps.

12. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Policy with a new "Last updated" date or by email. Your continued use of the Service after changes take effect means you accept the updated Policy.
